Any clause or condition of an order or other document submitted by Enterprise has no effect and is expressly denied. This agreement represents the entire agreement between you and Apple and governs your use of the Services, replacing all previous agreements regarding the same purpose between You and Apple. You may also be subject to additional terms and conditions that may apply if you use affiliate services, third-party content, third-party software or additional services such as the volume purchase program. If part of this agreement is declared invalid or unenforceable, that part must be interpreted in a manner consistent with applicable law in order to best reflect the parties` original intentions, and the other parties remain fully in force and effective.
Apple`s inability to enforce rights or provisions of this agreement does not constitute a waiver of that or other provision. Apple is not liable for non-compliance due to causes that are beyond its control. As noted in more detail below, this service plan has three different benefits for Apple business customers: (a) the high-end express service, which will be provided the next business day for repair or replacement services due to devices contained in accordance with the existing warranty provisions of the original sales agreement (s); (b) high-end repair or replacement service performed on the following business day for material and processing errors on landlocked equipment, after the expiry of the warranty agreement for the initial hardware sale contract, for an additional period determined by the warranty acquired; and (c) replacement of Apple iPhone, iPad or iPod Touch (“Services Devices”) or “Mac Service Components” requested by companies from Service Device Pools and Mac Service Components (“All” Replacement Pools) owned by Apple but made available to the company as it chooses.
